1. Acceptance of Terms

These Terms and Conditions constitute a legally binding agreement between you and fleetwyten regarding your use of our luxury vehicle arrangement services. By engaging our services, submitting a booking request, or using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree with any provision of these Terms, you must not use our services. We reserve the right to refuse service to anyone at our discretion.

These Terms are governed by the laws of Singapore and subject to the exclusive jurisdiction of Singapore courts.

2. Definitions

For purposes of these Terms:

"Service" refers to the luxury vehicle arrangement services provided by fleetwyten, including day drives, chauffeur services, and weekly residency arrangements.

"Client" or "You" refers to the individual or entity engaging our services.

"Vehicle" refers to any automobile provided through our arrangements.

"Arrangement Period" refers to the confirmed duration during which a vehicle is allocated to you.

"We", "Us", or "fleetwyten" refers to our company and its authorized representatives.

3. Eligibility Requirements

To engage our services, you must:

Be at least 25 years of age for day drive arrangements, or 21 years of age for chauffeur services.

Hold a valid driving licence issued by Singapore or an internationally recognized authority, applicable for a minimum of two years, for self-drive arrangements.

Provide accurate identification documents and contact information as requested.

Have the legal capacity to enter into binding contracts under Singapore law.

Meet any additional requirements specified for particular vehicle categories or arrangement types.

4. Booking and Confirmation

Arrangements are confirmed upon our written acceptance of your booking request and receipt of required deposit. All bookings are subject to vehicle availability at the time of confirmation.

We reserve the right to decline any booking request without providing reasons. Confirmation does not guarantee a specific vehicle make or model unless explicitly stated in writing, though we will endeavor to provide a vehicle of comparable quality and category.

Booking requests submitted less than 48 hours before the desired arrangement period are subject to availability and may incur expedited processing charges.

Any modifications to confirmed arrangements must be requested in writing and are subject to availability and potential adjustment fees.

5. Payment Terms

All fees are stated in Singapore Dollars (SGD) and must be paid in full unless alternative arrangements are agreed in writing.

Deposits and Prepayment

A deposit of 30% of the total arrangement fee is required upon booking confirmation. The remaining balance is due 48 hours before the arrangement period commences. For chauffeur services and weekly residencies, full payment is required 72 hours in advance.

Security Deposit

A refundable security deposit is held for the duration of self-drive arrangements. The amount varies by vehicle category and is specified at booking. The deposit is returned within 14 business days following satisfactory completion of the arrangement, less any deductions for damages, additional charges, or insurance deductibles.

Additional Charges

You are responsible for all charges incurred during the arrangement period including fuel costs, toll fees, parking charges, traffic violations, and any damages to the vehicle beyond normal wear. Late return fees apply at a rate of SGD 150 per hour or part thereof.

Payment Methods

We accept payment by bank transfer, credit card, and approved corporate accounts. Payment processing fees, if any, are the responsibility of the client.

6. Cancellation and Modification

Cancellations must be submitted in writing to [email protected].

Cancellation by Client

Cancellations made more than 72 hours before the arrangement period: full refund of deposit less 10% administrative fee. Cancellations made 48-72 hours before: 50% refund of deposit. Cancellations made less than 48 hours before: no refund of deposit.

Cancellation by fleetwyten

We reserve the right to cancel arrangements due to vehicle unavailability, mechanical issues, safety concerns, or other circumstances beyond our control. In such cases, we will provide full refund of all payments made and endeavor to offer alternative arrangements where possible.

Modifications

Requests to modify confirmed arrangements are accommodated where possible, subject to availability and potential adjustment fees. No modifications are permitted within 24 hours of the scheduled arrangement period.

7. Client Responsibilities

During the arrangement period, you agree to:

Operate the vehicle in a safe, lawful manner in compliance with all Singapore traffic regulations.

Maintain the vehicle in good condition and report any mechanical issues immediately.

Not permit any unauthorized person to operate the vehicle.

Not use the vehicle for commercial purposes, racing, or any illegal activities.

Not smoke or transport pets inside the vehicle without prior written authorization.

Return the vehicle at the agreed time and location in the same condition as received, normal wear excepted.

Immediately notify us of any accidents, damage, or mechanical failures.

Bear responsibility for all fines, penalties, and legal consequences arising from your use of the vehicle.

8. Insurance Coverage

All arrangements include comprehensive insurance coverage provided through our authorized insurance partners. Coverage details, deductibles, and exclusions are specified in the insurance documentation provided at booking.

The insurance deductible amount is the client's responsibility in the event of damage or loss. Standard deductibles range from SGD 3,000 to SGD 10,000 depending on vehicle category.

Insurance coverage may be voided if the vehicle is operated in violation of these Terms, by an unauthorized driver, under the influence of alcohol or drugs, or in circumstances excluded by the insurance policy.

Clients are encouraged to review insurance terms carefully and may arrange supplemental coverage at their own expense if desired.

9. Liability and Indemnification

To the fullest extent permitted by Singapore law, fleetwyten's liability is limited to the total fees paid for the specific arrangement giving rise to the claim.

We are not liable for indirect, consequential, special, or punitive damages including loss of profits, business interruption, or personal injury except as required by law.

You agree to indemnify and hold harmless fleetwyten, its officers, employees, and agents from any claims, damages, liabilities, and expenses arising from your use of the vehicle, violation of these Terms, or breach of any law or regulation.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under Singapore law.

10. Vehicle Condition and Inspection

At the commencement of each arrangement, we provide a vehicle in clean condition with all systems functioning properly. You are responsible for inspecting the vehicle and noting any pre-existing damage on the condition report.

Failure to note pre-existing damage may result in you being held responsible for such damage upon return. Photographs of the vehicle's condition are taken at handover and return for documentation purposes.

You must return the vehicle in the same condition as received, accounting for normal wear. Excessive wear, damage, or required cleaning beyond standard preparation will result in charges assessed against the security deposit.

11. Force Majeure

Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control including natural disasters, government actions, labor disputes, equipment failures, or other force majeure events.

In the event of force majeure preventing service delivery, we will provide full refund of all payments made, though we are not liable for any consequential losses.

12. Intellectual Property

All content on our website and in our materials including text, images, logos, and designs are the property of fleetwyten or our licensors and are protected by Singapore and international intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our content without written permission.

13. Privacy and Data Protection

Collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms. By accepting these Terms, you also accept our Privacy Policy.

We handle all personal data in accordance with the Singapore Personal Data Protection Act 2012 and related regulations.

14. Dispute Resolution

Any disputes arising from these Terms or our services shall first be addressed through good faith negotiation between the parties.

If negotiation does not resolve the dispute within 30 days, either party may pursue resolution through the Singapore courts. These Terms are governed by Singapore law, and the parties submit to the exclusive jurisdiction of Singapore courts.

Notwithstanding the foregoing, either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights or confidential information.

15. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy and any written agreements specific to your arrangement, constitute the entire agreement between you and fleetwyten regarding our services.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force and effect.

Waiver

Our failure to enforce any provision does not constitute a waiver of that provision or our right to enforce it in the future.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign our rights and obligations to any successor entity.

Notices

All notices required under these Terms must be in writing and sent to the contact information provided at booking or to [email protected].

16. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes become effective upon posting to our website. Continued use of our services after changes are posted constitutes acceptance of the modified Terms.

Material changes will be communicated through notice on our website or direct communication to registered clients. We encourage you to review these Terms periodically.

Arrangements confirmed before changes to these Terms remain subject to the Terms in effect at the time of confirmation unless both parties agree otherwise in writing.
